TERMS AND CONDITIONS
1LnE, LLC
Effective Date: 9.21.26
Last Updated: 9.21.26
1. Agreement and Scope
These Terms and Conditions (“Terms”) govern access to and use of the websites, applications, software, memberships, educational resources, and services provided by 1LnE, LLC (“1LnE,” “we,” “us,” or “our”).
These include 1LnE Pulse, the 1LnE Growth Lab community and mobile application ("Pulse" or “Growth Lab”), and related consulting, marketing, automation, implementation, and support services.
By accepting these Terms during registration or purchase, or using Services where these Terms have been presented as a condition of access, you agree to them. If acting for a business, you confirm that you have authority to bind that business.
An accepted order, proposal, statement of work, subscription agreement, or service-specific addendum may establish additional terms. Those documents control their specifically addressed scope, pricing, commitment, and deliverables if they conflict with these general Terms. Posting an updated price page does not retroactively change an accepted agreement.
Our handling of personal information is described in our Privacy Policy.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter an agreement to purchase Services or hold a Pulse or Growth Lab account.
Provide accurate account and billing information, keep it current, and protect your login credentials. Use individual authorized accounts where the platform supports them. Access is limited to the users and permissions included in your selected plan.
You are responsible for activity you authorize through your account. Notify us promptly if you suspect unauthorized access.
3. Packages, Features, and Included Support
Your selected offer identifies the software features, capacity, support, meetings, implementation time, and other benefits included in your purchase.
A software subscription includes the access and services expressly listed for that plan. Additional website production, campaign creation, migration, custom integrations, consulting, or ongoing implementation requires inclusion in the offer or separate approval.
A platform capability does not automatically include configuration of that capability. Access to an advertising platform does not automatically include advertising spend or campaign management.
Terms such as “unlimited,” when used for a software feature, remain subject to the disclosed platform, account, technical, and reasonable-use limits. They do not create unlimited production work or staff availability.
Growth Lab benefits follow the membership offer accepted at enrollment. Membership does not automatically include a Pulse subscription or private consulting unless the offer expressly includes them.
4. Setup and Implementation
Setup may be self-guided, guided, or completed by 1LnE within an agreed scope.
The accepted scope determines deliverables, included setup and training time, revision limits, data-import requirements, dependencies, and separately billed work.
Standard Start ordinarily combines a subscription with a separately charged setup service. Easy Start provides the defined standard setup without an upfront setup charge, subject to its higher monthly rate and initial commitment.
Selecting an additional launch service does not authorize duplicate charges for the same approved setup work. Any expanded scope or additional charges must be identified and approved.
You agree to provide the materials, access, decisions, and approvals reasonably needed to complete the work. Customer delays may affect delivery dates. Subscription billing begins on the disclosed subscription start date and does not automatically pause because customer materials or approvals are outstanding.
Dates dependent on carriers, app stores, domain providers, integrations, or customer action are estimates unless expressly guaranteed in writing.
5. Prices, Payments, and Automatic Renewal
The price, billing frequency, initial term, renewal arrangement, taxes, and applicable additional charges are disclosed in your accepted offer or checkout.
Unless stated otherwise, prices are in U.S. dollars.
When you select and authorize a recurring subscription, it renews at the disclosed interval until canceled, subject to any agreed initial term. Monthly subscriptions renew monthly. Annual subscriptions renew annually only where that recurring arrangement was disclosed and accepted.
You authorize charges for the subscription, approved additions, disclosed usage, applicable taxes, and other amounts properly due under your agreement. Keep your payment method current.
An installment schedule for a fixed project or purchase spreads payment of that purchase; it does not turn the purchase into a cancel-anytime monthly subscription.
Any trial or promotional conversion to a paid subscription must be disclosed and authorized before recurring charges begin.
We provide at least 30 days’ advance notice of an increase to an existing recurring subscription price, or longer where required. Increases apply prospectively and respect any agreed fixed-price term. You may cancel before an increased renewal takes effect, subject to lawful obligations under an existing commitment.
Approved changes to usage rates or third-party charges are handled under the applicable rate disclosures and notice requirements.
6. Easy Start Agreements
Easy Start requires an initial term of 12 consecutive monthly billing cycles unless a different written agreement expressly applies.
The accepted agreement must identify:
The selected plan and Easy Start monthly rate.
The subscription start date and initial term.
The included setup scope.
The setup-recovery amount and credit schedule.
Early-cancellation obligations and payment timing.
The rate and cancellation arrangement after the initial term.
If you cancel during the initial term, the remaining setup-recovery balance is calculated using the recovery amount and credits stated in your accepted agreement. Only qualifying completed and paid billing cycles earn those credits.
The recovery balance is separate from valid unpaid subscription charges, usage, approved work, and taxes. These general Terms do not supply an undisclosed recovery formula.
After 12 completed and paid monthly cycles, Easy Start continues month-to-month at the Standard rate applicable under the accepted agreement, unless another plan is selected or service is canceled. Applicable price-change and renewal notices still apply.
Downgrades or other changes during the initial term follow the Easy Start agreement and do not automatically eliminate an existing setup-recovery obligation.
7. Usage Credits and Additional Charges
Where a plan includes a monthly communication or AI usage credit, the credit applies to eligible services identified for that plan.
Unused included monthly credits do not roll over or have cash value unless your accepted offer expressly states otherwise. Separately purchased prepaid balances follow the terms disclosed for those balances.
Examples of email, message, call, or AI quantities are estimates when presented as such. Actual consumption depends on factors such as message segmentation, destination, duration, carrier charges, and the AI feature used.
Usage exceeding the included credit is billed at the applicable disclosed rates, which may include a 1LnE markup.
Phone numbers, registration fees, premium integrations, third-party subscriptions, domain renewals, advertising spend, and similar expenses may be billed separately where disclosed and authorized.
We obtain authorization for any automatic usage-wallet recharge arrangement before enabling charges under that arrangement.
8. Cancellation
For subscriptions billed directly by 1LnE, use an available billing-portal cancellation option or email [email protected]. Include your business or account name and the service you wish to cancel.
Unless a service-specific agreement establishes a different lawful notice requirement, cancellation takes effect at the end of the current paid billing period. Submit your request before the next renewal. Its effective date is based on receipt of the request, not on when staff finishes processing it.
We confirm cancellation and identify any remaining contractual obligations.
Canceling during an Easy Start or other minimum commitment remains subject to the applicable accepted agreement.
For subscriptions purchased through an app store, manage cancellation through that store’s subscription settings. Contact us if you need assistance identifying how a purchase is billed.
Uninstalling an app, ceasing to use a service, or leaving a community does not itself cancel a paid subscription.
9. Refunds and Billing Questions
Subscription fees are generally nonrefundable and are not prorated for unused portions of a paid billing period, except where required by law, stated in the accepted offer, or agreed by 1LnE.
For canceled setup or project work, the applicable project agreement controls. If it does not address cancellation, charges are limited to work performed and authorized, nonrecoverable third-party commitments; any remaining prepaid amount is refunded.
Refund conditions for separately purchased digital products or events are disclosed with the offer. App-store purchases are also subject to the store’s applicable refund process.
These provisions do not remove rights concerning billing errors, failure to provide contracted services, or other remedies required by law.
Report a suspected billing error to [email protected] so we can investigate. Contacting us does not waive your lawful rights with your payment provider.
10. Customer Responsibilities
You are responsible for the accuracy and lawful use of information, branding, offers, customer data, and other materials you supply.
You agree to:
Obtain the rights and permissions needed for submitted content and contact data.
Provide timely access, feedback, and approvals.
Review customer-facing content, workflows, offers, and AI configurations before their approved use.
Maintain necessary business licenses and industry-specific disclosures.
Use appropriate consent and communication practices.
Keep copies of records and assets important to your business.
Publishing or sending materials on your behalf requires the authorization established in your project scope or approval process.
Do not submit regulated or highly sensitive information through a service unless its configuration, contractual protections, and approved use support that information.
11. Growth Lab Community Rules
Growth Lab is a professional learning and business community. Members must treat others respectfully and use the community for its intended purposes.
You may not:
Harass, threaten, discriminate against, or impersonate another person.
Share unlawful, sexually explicit, infringing, or malicious content.
Disclose another person’s confidential or personal information without authority.
Scrape member details, harvest contacts, or send unsolicited bulk promotions.
Share account access or redistribute restricted membership content.
Misrepresent results, credentials, affiliations, or endorsements.
Disrupt discussions, bypass restrictions, or misuse reporting tools.
Promotional posts must follow the rules of the relevant group or channel.
Report inappropriate content or behavior through available reporting features or by emailing [email protected]. We may investigate, remove content, restrict features, or suspend accounts when reasonably necessary to enforce these Terms.
Members remain responsible for their own advice, offers, and transactions. Participation does not create a partnership, employment, agency, or endorsement relationship with 1LnE.
12. Content, Templates, and Intellectual Property
You retain your rights in content and business information you provide.
You authorize 1LnE and its providers to host, process, reproduce, format, transmit, and display that content as reasonably necessary to deliver the Services to your intended audience, maintain security, and provide support.
This permission does not grant a general right to use your identifiable content, business name, or logo in our advertising. We obtain separate permission for testimonials, case studies, and promotional endorsements.
1LnE and its licensors retain rights in their pre-existing software, methods, training materials, templates, and other intellectual property.
Unless a resource states otherwise, Growth Lab resources may be used and adapted for your own business activities. They may not be resold, repackaged as a competing resource library, or redistributed in source form to nonmembers. Materials expressly provided for client work may be used within their stated license.
Ownership, licensing, source-file delivery, and transfer of custom project deliverables are governed by the accepted project agreement and any applicable third-party licenses.
Report suspected infringement to [email protected] with enough information to identify the material and your claim.
13. AI, Educational Content, and Results
AI tools can produce inaccurate, incomplete, or unsuitable information. Review outputs before relying on them, publishing them, or using them in decisions affecting others.
AI receptionists and automated tools are not emergency services. Do not use them as the sole means of handling urgent safety matters.
Training, templates, calculators, community discussions, and general business guidance are educational resources. They do not establish an attorney-client relationship or replace professional advice suited to your circumstances.
Any specifically contracted bookkeeping, accounting, or other professional service is governed by its engagement terms.
We do not guarantee a particular revenue level, number of leads, conversion rate, ranking, tax result, platform approval, or business outcome. Results depend on the service, customer participation, market conditions, and other factors.
14. Marketing and Communication Compliance
When using 1LnE Pulse or other tools to communicate with your contacts, you are responsible for having the lawful basis and any required consent for the communication.
You must maintain appropriate permission records, honor opt-outs, use accurate sender information, and comply with applicable advertising, privacy, calling, email, and text-message requirements.
Access to software, phone registration assistance, or an automation template does not constitute approval of a contact list or campaign.
We may restrict campaigns or messaging that reasonably appear unlawful, abusive, misleading, or inconsistent with provider requirements. Each party remains responsible for obligations imposed on it by law.
15. 1LnE Text Messaging Terms
If you opt in to receive text messages from 1LnE, messages may concern inquiries, appointments, account assistance, service updates, events, or promotional offers within the scope of your consent.
Participation is optional and is not required to purchase a service.
Message frequency varies. Message and data rates may apply.
To stop messages, reply STOP to the sending number. A confirmation may follow, after which messages under that consent will stop. To enroll again, complete a new opt-in.
For help, reply HELP, email [email protected], or call 920.944.6185.
Carriers are not liable for delayed or undelivered messages.
Tell us if you stop using a number previously provided for messaging. Our Privacy Policy explains how mobile information and consent records are handled.
16. Third-Party Platforms and Mobile Applications
Some Services depend on providers such as HighLevel/LeadConnector, payment processors, communication carriers, advertising networks, hosting providers, and app stores.
Third-party features may be subject to separate terms presented for the relevant service. Their availability, technical limits, approval processes, and permitted uses may change.
You are responsible for separately purchased third-party services unless our agreement states that 1LnE manages them.
We remain responsible for our own contractual obligations. We cannot guarantee uninterrupted operation of systems outside our control.
Mobile applications also depend on compatible devices, supported operating systems, internet access, and applicable app-store rules. App-store purchase and subscription procedures apply where that store handles the transaction.
17. Data Access, Exports, and Account Closure
Your business records and customer information remain subject to your rights and the rights of the individuals concerned.
You may request available exports of your account data. Export formats, transferable features, and migration options depend on the platform and your agreement. Custom migration assistance may require a separately approved scope and fee.
Arrange business-data exports and any available domain, phone-number, or account transfers before service access ends. A transfer is subject to provider rules and technical availability.
Personal-information access and deletion requests follow our Privacy Policy. A subscription cancellation and a privacy deletion request serve different purposes; tell us if you want both.
We retain or delete information according to the Privacy Policy, applicable agreements, and legal requirements.
18. Suspension and Termination
We may suspend or end access for a material breach of these Terms, unpaid valid charges, security threats, unlawful activity, or provider restrictions.
Where practical and appropriate, we provide notice and a reasonable opportunity to correct the issue. Immediate restriction may be necessary to protect people, information, or systems.
If we discontinue a prepaid service for reasons unrelated to your breach, we will provide a reasonable transition or refund the unused prepaid portion of the discontinued service.
Ending access does not eliminate valid charges already incurred or other obligations that reasonably continue after termination.
19. Service Standards and Warranty Limitations
We will perform agreed services with reasonable care and skill and honor express commitments in the accepted agreement.
Software and online resources may experience interruptions, errors, maintenance, or changes. We do not promise that every feature will meet every individual requirement or operate without interruption.
To the extent permitted by law, warranties beyond those expressly stated in the accepted agreement or required by law are excluded.
Nothing in these Terms excludes a nonwaivable warranty or remedy.
20. Limitation of Liability
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses arising from these Terms, including lost profits or lost business opportunities.
1LnE’s aggregate liability arising from the Services is limited to the greater of:
The fees you paid to 1LnE for the affected Services during the 12 months before the event giving rise to the claim; or
$100.
These limits do not apply to fraud, intentional misconduct, gross negligence, or liability that applicable law does not permit a party to exclude or limit.
A service-specific agreement may establish different liability terms.
21. Business-Customer Claims Involving Supplied Materials
If you use the Services for a business, you agree to reimburse 1LnE for reasonable losses and defense costs arising from a third-party claim caused by your unlawful supplied content, infringement of another party’s rights, or material misuse of the Services.
This obligation does not cover losses caused by 1LnE’s own breach, negligence, or misconduct.
We will promptly notify you of a relevant claim and provide a reasonable opportunity to participate in its defense. No settlement may impose an admission or nonmonetary obligation on you without your consent.
22. Disputes and Governing Law
Please contact [email protected] so we can attempt to resolve a concern directly. This request does not prevent either party from seeking urgent relief or exercising rights within an applicable deadline.
Wisconsin law governs these Terms, subject to any mandatory protections that apply where you live or operate.
Unless a service-specific agreement lawfully provides otherwise, disputes may be brought in Wisconsin state or federal courts with jurisdiction. This provision does not remove a consumer’s nonwaivable right to bring a claim in another legally required forum.
23. Changes to These Terms
We may revise these Terms as the Services or legal requirements change. We will publish an updated version and effective date.
For material changes affecting an existing ongoing service, we provide reasonable advance notice and obtain renewed acceptance where required. Urgent legal or security changes may require a shorter notice period.
Changes do not retroactively alter accrued rights or override an accepted fixed-term commitment. Subscription price changes follow Section 5.
24. General Provisions
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
A delay in enforcing a provision does not waive the right to enforce it later.
These Terms and the applicable accepted service documents form the agreement for the Services they cover. Neither party may transfer an agreement in a way that unlawfully reduces the other party’s rights.
Provisions concerning valid outstanding payments, intellectual property, privacy, liability, and disputes continue after termination where their purpose requires it.
